This TOS constitutes the entire agreement between you and the owners and managers of this site governing your use and access to the site, superseding any prior agreements or discussions relating thereto.  To the extent that any linked or affiliated services become available on or through this site, you may also be subject to the terms of service upon which such material may be used or accessed.

This agreement will go into force and be performed in whole or in part in the State of Texas, and will be construed and governed in accordance with the laws of the State of Texas.

DISPUTE RESOLUTION  

In the event of any dispute concerning any aspect of any matter contemplated by this agreement, the dispute will be submitted to binding arbitration, pursuant to the Federal Arbitration Act, before the American Arbitration Association, pursuant to its Commercial Rules, at its offices located in Houston, Texas. The site owner may, notwithstanding this arbitration provision, have resort to any court of competent jurisdiction to seek injunctive relief deemed by the site owner in its sole and absolute discretion to be appropriate for the protection of the site and/or its ownership interests in it.  The prevailing party in any of such proceedings, arbitration and litigation, will be entitled to recover, in addition to any other relief, its expenses incurred in connection with the proceeding and its enforcement, including its attorney fees. The arbitral award will not include any exemplary or punitive damages, or any damages for emotional injury or pain and suffering, and will be final and not subject to appeal. It may be confirmed and enforced in any court of competent jurisdiction.
